Terms of Service

Welcome to Wayk. These Terms of Service ("Terms") govern your access to and use of the Wayk mobile application (the "App"). By downloading, installing, or using Wayk you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use Wayk. If you are under the age of majority in your jurisdiction, a parent or guardian must agree to these Terms on your behalf.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use Wayk for personal, non-commercial use on devices you own or control, subject to these Terms and Apple's standard EULA.

3. Subscriptions and payments

• Wayk offers optional auto-renewing subscriptions ("Premium") billed through your Apple ID.
• Payment is charged to your Apple ID at confirmation of purchase.
• Your subscription renews automatically unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel subscriptions anytime in iOS Settings → [Your Name] → Subscriptions.
• No refund is provided for the unused portion of a paid period, except where required by law.
• Prices and features may change; you'll be notified before a renewal at a new price.

4. Alarms and safety disclaimer

Wayk is a productivity/wake-up tool. It is not a medical device and must not be used as the sole alarm for safety-critical tasks (flights, medication, driving schedules). Mobile alarms can fail for reasons outside our control (low battery, OS updates, Do Not Disturb, silent mode on non-critical notifications, backgrounded audio, revoked permissions). You agree to use a backup alarm when missing a wake-up could cause harm.

5. Missions and camera use

Certain missions use the camera and motion sensors. You are responsible for your safety while performing a mission (e.g., do not run a pushup mission on a wet floor). Do not use Wayk while driving or operating machinery.

6. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or tamper with the App.
• Use the App to harass, threaten, or harm others.
• Attempt to circumvent subscription, rate-limit, or entitlement checks.
• Use automated tools to scrape or interfere with Wayk's services.

7. User content

Alarms, labels, and custom sounds you create remain yours. Photos captured for missions are processed on-device and never uploaded. You are responsible for anything you enter.

8. Intellectual property

The App, including code, design, logo, text, and sounds, is owned by Wayk and protected by copyright and trademark law. These Terms do not transfer any intellectual-property rights to you.

9. Third-party services

Wayk integrates with Apple, Firebase, Mixpanel, and Adapty. Your use of those services is subject to their own terms.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ALARMS WILL ALWAYS FIRE, THAT MISSIONS WILL ALWAYS DETECT CORRECTLY, OR THAT THE APP WILL BE ERROR-FREE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAYK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Termination

We may suspend or terminate your access to the App if you breach these Terms. You may terminate at any time by uninstalling the App. Sections that by their nature should survive termination (IP, disclaimers, limitation of liability, governing law) will survive.

13. Changes

We may update these Terms. Material changes will be announced in the App. Continuing to use Wayk after changes take effect constitutes acceptance of the new Terms.

14. Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles. Disputes will be resolved in the courts of Istanbul, unless applicable consumer protection law grants you additional rights.
